Professional representation is mandatory
According to the ‘UPC Agreement’, parties must be represented either by a lawyer authorised to practise before a court of a ‘UPC Contracting State’, or by a European Patent Attorney with appropriate qualifications, such as the European Patent Litigation Certificate. An individual claimant must employ a professional representative to defend their rights – both as plaintiff and as defendant.
Division depends on the case
The division of the UPC depends upon the defendant’s location or the infringement’s nature, and on the technology sector: Local (within a specific EU member state); Regional (Nordic-Baltic, Stockholm); Central divisions (DE, IT, FR); Court of Appeal (Luxembourg).
We can represent your UP or EP before the UPC. The representation of the interested party in the UPC may take place in different divisions of the UPC. An interested party may order the service when it wants to defend its rights in front of the court – also when the interested party is the defendant sued in the UPC.
