    Translation requirements

    To perform a European patent validation in Lithuania only the claims need to be translated.

    Our translations are prepared by tested translators having professional experience in patent translations, translators keep up up-to-date glossary. Each translation is checked by local Patent Attorney or other internal or external specialist who has experience in patent translations and we follow ISO 17100 standard in our translation process.

    Filing deadline

    Within three months after the date on which the mention of grant is published in the European Patent Bulletin.

    Extension of deadline is not possible.

    Power of attorney

    The Power of Attorney is required. The POA can be specific or general. Copy of the POA is sufficient.

    Patent annuities

    We offer patent annuities payment and monitoring service. Monitoring of patent annuities is free of charge service.

    The annual fee shall be paid within two last months of the current year of patent validity. The annual fee increased by 50% (firm fee remains the same) may still be validly paid within 6 months from the due date as prescribed above.

    Patent annuities

    We offer patent annuities payment and monitoring service. Monitoring of patent annuities is free of charge service.

    Annuities should be paid for each year following the year of grant of a patent. The due date is the last day of the month on which the filing date anniversary falls. In case of late payment, the official fee increased by 25% (firm fee remains the same) may still be validly paid within 6 months from the due date.

    Filing deadline

    Within three months after the date on which the mention of grant is published in the European Patent Bulletin.

    Extension of deadline is possible: up to 2 months upon payment of the corresponding official fee.

    Power of attorney

    The Power of Attorney is not required.

    Patent annuities

    Payment may not be made more than 6 months before due date. The due date is the last day of the month on which the filing date anniversary falls. In case of late payment, the official fee increased by 10% (firm fee remains the same) may still be validly paid within 6 months from the due date.

    Estonian Patent Office does not issue any annuity fee reminders.

    To perform a European patent validation in Poland whole patent specification into Polish language needs to be translated.

    To perform a European patent validation in Sweden only the claims need to be translated in Swedish if a European patent has been granted in English.

    If a European Patent has been granted in French or German, translation of the description into English and Swedish translation of the claims must be submitted.

    France is sharing an official EPO language, therefore there are no requirements for filing a translation and paying a publication or EP validation fee.

    Filing deadline

    When  EP is granted, it becomes automatically and immediately a valid patent in this country. However, it is highly recommended to appoint a representative as a point of contact.

    Power of attorney

    The Power of Attorney is not required.

    Patent annuities

    In order to have a right in France, annuity fees must be paid directly to the French Patent Office every year.

    United Kingdom is sharing an official EPO language, therefore there are no requirements for filing a translation and paying a publication or EP validation fee.

    Filing deadline

    When  EP is granted, it becomes automatically and immediately a valid patent in this country. However, it is highly recommended to appoint a representative as a point of contact.

    Power of attorney

    The Power of Attorney is not required.

    Patent annuities

    In order to have a right in United Kingdom, annuity fees must be paid directly to the UK Patent Office every year.

    The annual fees may be paid within 3 months prior to the date on which the previous protection term ends. In case of late payment, the official fee increased by :

    2nd month: GBP 24

    3rd month: GBP 48

    4th month: GBP 72

    5th month: GBP 96

    6th month: GBP 120

    (firm fee remains the same) may still be validly paid within 6 months from the due date.

    European Patent Validations and Patent Annuities

    Once the mention of the grant is published, the European patent has to be validated in each of the designated countries within a specific time limit (within 3 months) in order to retain its protective rights and be enforceable against infringers. This validation step consists of the filing of the translated claims or translation of full specification into an official language of that state with national patent office and the payment of a fee (the fee is different in each country).

    A European patent will only extend to those countries in which a validation is filed. The rights will lapse in any country where the validation is not filed. The European patent will remain active in any validated country as long as annuities are paid.

    The annuity fees are to be paid every year to the EPO (starting at 505 EUR) up to the granting of the application, from the second anniversary of the filing date. Thereafter, an annuity fee (the fee is different in each country) is payable annually to the National Intellectual Property office in which the granted European patent has been validated. If an annuity fee is not paid in due time the fee may still be paid up to 6 months late provided that a 50% surcharge is also paid.
