What UP representation services do we offer?

Representation of the UP and the EP before the UPC

One of the upcoming UP services – representation. We can represent your UP or EP before the UPC. In this case, the representation of the interested party in the UPC may take place in different divisions of the UPC.

Relevance:

According to the ‘UPC Agreement,’ only a solicitor or a patent lawyer from a ‘UPC Contracting State’ may represent the defendant in the UPC (court). It means that an individual claimant (the patent holder or any interested party) must employ a professional representative to defend their rights in cases where the individual acts as the plaintiff or defendant.

What does the location depend on?

The division of the UPC depends upon the defendant’s location or the infringement’s nature. Also, it depends on the technology sector involved:

  • Local (within a specific EU member state);
  • Regional (if two or more EU member states have an agreement to establish a regional court, i.e., the ‘Nordic-Baltic Regional Division’ in Stockholm, Sweden);
  • Central divisions (depending upon the technology sector, this will either be in Germany, Italy, or France);
  • The Court of Appeal (in Luxembourg).
Timing/order:

An interested party may order the service when it wants to defend its rights in front of the court. It is also possible when the interested party is the defendant sued in the UPC.
